PHOENIX \u2014 A lawsuit has been filed against the parents of an 18-year-old who hosted a party and allegedly provided alcohol to minors.\u00a0<\/p>\n

According to the lawsuit documents filed, on April 13, the parents allowed their son to host a “Senior Ditch Day” party at their property near 40th Street and Chandler Blvd in Phoenix.\u00a0<\/p>\n<\/p><\/div>\n

At this party, where, according to the complaint, 17 and 18-year-olds were invited, they were also encouraged to bring their own alcohol. Allegedly, the homeowners provided alcohol as well.<\/p>\n<\/p><\/div>\n

\n

The complaint states that there were over 60 high schoolers at the party, including the plaintiff, who is 17. According to the lawsuit, the plaintiff consumed alcohol at the party, was injured, and was taken by ambulance to the hospital.\u00a0<\/p>\n<\/p><\/div>\n

Video of the incident shows the teen along with others on the roof of the home and then jumping into the pool. The defendant’s attorney, Brian Foster, said that when his client landed, his head hit the pool deck, knocking him unconscious, and his ear was severely injured from the impact.<\/p>\n<\/p><\/div>\n

\n

The blood alcohol concentration for the plaintiff was .114; the limit BAC in Arizona is .08 for 21+.\u00a0<\/p>\n<\/p><\/div>\n

\n

“Clearly, my guy made a very poor judgment, and he will be held partially responsible for his conduct, but the overwhelming of fault will be assessed to the homeowners for hosting an alcohol party for a bunch of 17-year-old high school students,” Foster said.<\/p>\n<\/p><\/div>\n

\n

According to the lawsuit, it claims the homeowners did nothing to prevent the consumption of alcohol by minors or stop the reckless activities, including jumping off the roof into the swimming pool.<\/p>\n<\/p><\/div>\n

\n

According to the complaint, the defendants were notified “of their obligation to preserve all evidence relating to this incident,” including photos, videos, emails, texts, outdoor surveillance video, and any other material related to the party.\u00a0<\/p>\n<\/p><\/div>\n

\n

The plaintiff claims that the homeowners “failed to maintain the property in reasonably safe conditions, failed to exercise reasonable care in planning, organization, supervision and\/or conduct of the social gathering at the property,” among other alleged acts of negligence.\u00a0<\/p>\n<\/p><\/div>\n

\n

The plaintiff is asking for monetary compensation for past and future medical expenses, “pain and suffering; pain, suffering and emotional distress, loss of enjoyment of life,” and more.\u00a0<\/p>\n

Foster said he tried contacting the homeowners to get their insurance for the medical expenses but never heard back. Leading to the lawsuit being filed.<\/p>\n<\/p><\/div>\n

“This was a tragic gross negligence on the part of the parents, you know, and hopefully be a big lesson for them and other members of the community, because there are absolute consequences to this type of action,” Foster said.<\/p>\n<\/p><\/div>\n

\n

12News spoke to one of the defendants over the phone. They said that due to false claims in the lawsuit, they are hiring their own lawyer, and further communication would be coming from their attorney.<\/p>\n<\/p><\/div>\n
