\n

A proposed $2.5 million class action settlement has been reached in federal court over a data security incident that took place between Aug. 17 and Aug. 19, 2024, in which an unauthorized third party accessed Fidelity’s computer network and potentially obtained customers’ personal information, including names, Social Security numbers, financial account and routing numbers and driver’s license information.<\/p>\n<\/p><\/div>\n

Fidelity denies wrongdoing but has agreed to a settlement.\u00a0<\/p>\n<\/p><\/div>\n

\n

Do you qualify?<\/h2>\n<\/p><\/div>\n
\n

You are eligible to file a claim if you are a U.S. resident and received a notice of the data breach from Fidelity, or if your bank account number and routing number were exposed in the incident.\u00a0<\/p>\n<\/p><\/div>\n

\n

Joint account holders with a single compromised account may submit only one claim.<\/p>\n<\/p><\/div>\n

What can you receive?<\/h2>\n<\/p><\/div>\n
\n

The settlement offers three types of benefits to eligible class members:<\/p>\n<\/p><\/div>\n

\n

Cash payment:<\/strong> All class members can claim a cash payment, currently estimated at $100. The final amount may be higher or lower depending on how many people file claims.<\/p>\n

\n

Reimbursement for out-of-pocket losses:<\/strong> If the data breach caused you documented financial harm \u2014 such as identity theft losses, fees to freeze your credit, the cost of replacement IDs or credit monitoring services, or even postage and gas spent resolving fraud \u2014 you can claim reimbursement of up to $5,000. You will need to provide proof such as bank statements or receipts. Self-written notes alone are not sufficient but can be used to supplement other documentation. California residents may also claim an additional $50 payment under the California Consumer Privacy Act.<\/p>\n<\/p><\/div>\n

\n

Identity theft protection:<\/strong> All class members are eligible to enroll in two years of CyEx Financial Shield Complete, which includes $1 million in financial fraud insurance and monitoring.<\/p>\n<\/p><\/div>\n

\n

How to file a claim<\/h2>\n<\/p><\/div>\n
\n

The fastest and simplest way to file is online at www.FidelityDataSettlement.com. Paper claim forms can also be downloaded from that site and mailed.\u00a0<\/p>\n<\/p><\/div>\n

\n

All claims must be received or postmarked no later than July 27, 2026.<\/p>\n<\/p><\/div>\n

\n

Settlement deadlines<\/h2>\n<\/p><\/div>\n
\n

Class members who do not want to be part of the settlement and wish to preserve their right to file their own lawsuit against Fidelity must formally opt out by June 26. Opting out means forfeiting any settlement benefits.<\/p>\n<\/p><\/div>\n

\n

If you do nothing, you will receive no payment and will give up the right to sue Fidelity over the data breach covered by the settlement.\u00a0<\/p>\n
