PHOENIX — Ian Mitcham was sentenced Thursday for burglary and sexual assault, but is still waiting to learn his fate for the murder of Allison Feldman.

A judge sentenced Mitcham to 3.5 years in prison for burglary and 7 years for sexual assault.
Allison’s sister and friend made emotional statements to the judge about how Allison was “stripped of her dignity” in her final moments.
Mitcham was previously convicted of Feldman’s 2015 murder in Scottsdale. Prosecutors described the killing as a “crime of opportunity,” saying Mitcham did not know Feldman and was later tied to the scene through DNA evidence.

A judge declared a mistrial in the penalty phase of Mitcham’s murder case after jurors were unable to unanimously decide whether Mitcham should receive the death penalty or life in prison.
Mitcham’s attorney said Mitcham maintains his innocence.
The Maricopa County Attorney’s Office must now decide whether or not to retry the penalty phase of the murder trial and continue to pursue the death penalty.
